Terms of Service

The terms that govern your use of the AllocClarity platform and our API.

Last updated: 17 September 2026

1. Who we are

These Terms of Service ("Terms") govern your access to and use of the AllocClarity website at allocclarity.com, our platform, API, reports and any related services (together, the "Services"). The Services are provided by AllocClarity, Lda., a private limited company (sociedade por quotas) registered in Portugal, with its registered office in Lisbon, Portugal ("AllocClarity", "we", "us" or "our").

2. Acceptance of these Terms

By accessing or using the Services you agree to be bound by these Terms. If you use the Services on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf, and "you" refers to that organisation. If you do not agree, do not use the Services.

Where you have signed a separate written agreement with us (for example, an order form or subscription agreement), that agreement takes precedence over these Terms to the extent they conflict.

3. Who the Services are for

The Services are intended for institutional, professional and agentic use only. They are not directed at retail consumers. You confirm that you are acting in the course of a business or profession and that you are legally permitted to use the Services in your jurisdiction.

4. Not investment advice

AllocClarity does not provide investment, financial, legal, tax or accounting advice. The Services deliver algorithmic assessments of digital-asset data, including risk scores, yield comparisons and portfolio analytics, generated by proprietary models. These outputs are informational only and are not a recommendation to buy, sell, hold or deposit into any asset, vault or protocol.

Risk scores describe relative risk under our methodology at a point in time. They are not a guarantee of safety, a prediction of future performance, or a probability of loss. Digital assets and decentralised finance carry substantial risk, including the total loss of funds. You retain full responsibility for your own investment decisions and for your compliance with any regulatory obligations that apply to you.

5. No custody, no execution

AllocClarity is a technology and data-analytics provider. We do not hold, control or manage customer funds or private keys, and we do not execute transactions on your behalf. Any transaction you make is initiated by you, and you are solely responsible for confirming it.

6. Accounts and access

Some Services require an account or API credentials. You are responsible for keeping your credentials confidential, for all activity under your account, and for notifying us promptly at team@allocclarity.com of any unauthorised use.

7. Acceptable use

You agree not to:

  • use the Services for any unlawful purpose, or in breach of applicable sanctions or anti-money-laundering laws;
  • resell, redistribute, sublicense or publicly republish the Services or their outputs except as permitted in your agreement with us;
  • scrape, crawl or bulk-extract data from the Services other than through the API within your plan's limits;
  • reverse engineer, copy or attempt to derive our models or methodology;
  • interfere with, disrupt or attempt to gain unauthorised access to the Services or their infrastructure;
  • use the Services to build a competing product.

8. Data accuracy and availability

Our outputs rely on on-chain data and third-party sources that may be delayed, incomplete or wrong. We work to keep the Services accurate and available but provide them "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose or uninterrupted availability. We may change, suspend or discontinue any part of the Services.

9. Intellectual property

The Services, including our software, models, methodology, risk scores, reports, trademarks (including "AllocClarity") and content, are owned by AllocClarity or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes. Reports we deliver to you may be shared with your investment committee, auditors and regulators.

You keep all rights in data you provide to us, such as wallet addresses and portfolio details, and grant us a licence to use it only to provide and improve the Services.

10. Limitation of liability

To the maximum extent permitted by law, AllocClarity will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, funds, data or goodwill, arising out of or related to the Services, including any investment decision made using them. Our total liability for any claim arising out of or relating to the Services is limited to the fees you paid us in the twelve months before the claim arose, or EUR 100 if you have paid nothing. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnity

You will indemnify AllocClarity against claims, losses and expenses arising from your breach of these Terms, your misuse of the Services, or your investment decisions.

12. Suspension and termination

We may suspend or terminate your access if you breach these Terms or if required by law. You may stop using the Services at any time. Sections that by their nature should survive termination, including 4, 5, 8, 9, 10 and 11, will survive.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date, and for material changes we will notify account holders in advance. Continued use of the Services after changes take effect means you accept them.

14. Governing law and disputes

These Terms are governed by the laws of Portugal. The courts of Lisbon, Portugal have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
